Personal Information supplied by you while making use of any of our Tools4 websites (“Service”) is provided voluntarily to Tools4 Africa (Pty) Ltd. If you choose to use our Service, then you acknowledge that such conduct constitutes an unconditional, specific and voluntary consent to the processing (including retention) of such information as set out in terms of this Policy. This Policy is complementary to our online Privacy Statement as well as the online Shopping and other related Terms and Conditions which are accessible on any of the tools4 websites unless otherwise defined in this Privacy Policy. All of these documents must be read together and form part of your agreement with us.

Personal information is any information that identifies or relates specifically to You as the Data Subject, including, for example, Your name, age and identity number, Your contact address, Your location, Your banking details, Your identification number and contact numbers. In short, any information that We know about You will be regarded as Your personal information. You agree that you will provide accurate information to us and keep it updated (when it changes), and that you will not create a false identity or account for anyone other than yourself.

4.1 The following Personal Information is collected by or on behalf of Tools4 Africa from You, the documentation We request and You provide or from information about You that is publicly available as well as from third parties from whom We are authorised to collect the personal information or which, by law We are entitled to collect.
4.1.1.Information that you provide to Tools4 Africa.
4.1.1.1. When you register, create or update your account on the website, we require You to provide Us with personal information which includes but is not limited to your name and surname, email address, mobile number, login name and password, physical address, payment or banking information, identification numbers, birth date and delivery information.
4.1.1.2. Information required and given when you contact us, including for customer support. We want to provide You with the best possible service, so calls to Tools4 Africa (Pty) Ltd will be recorded and/or monitored for quality checks and staff training. Recordings may also be used to help us combat fraud.
4.1.1.3. Information given when You complete surveys sent to You by or on behalf of Tools4 Africa.
4.1.2. Information created when You use Our Sites or services.
4.1.2.1. Transaction information – We collect transaction details relating to Your use of Our Sites and Services (including the type of Services You requested, date and time of the Service, and amount of the Service).
4.1.2.2. Usage and preference information – We collect information about how You interact with Our Sites, preferences expressed, and settings chosen. In some cases, We do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers.

4.1.3. Information from other sources Information from payment processors, marketing service providers, third party business partners.
4.2 Tools4 Africa (Pty) Ltd may combine information collected from these sources with other information in its possession.
4.3 Should Your personal information change, please inform Us and provide Us with updates to your personal information as soon as reasonably possible to enable Us to update Your personal information.
5. What We Use Your Personal Information for (Purpose)
5.1 You agree that We may process Your personal information for the following purposes to facilitate essential communication such as:
5.1.1. to facilitate the ordering, sale, delivery of and payment for Goods and use of the Sites;
5.1.2. to create and update Your account;
5.1.3. to verify Your identity;
5.1.4. to improve Our product selection and Your experience on the Sites by, for example, monitoring Your browsing habits, or tracking Your sales on the Sites;
5.1.5. to enable transportation and delivery of Your purchases;

5.1.12. to confirm order and delivery details either via email, text or a phone call;
5.1.13. to investigate or address claims or disputes relating to Your use of Our Sites and Services, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and regulatory;
5.1.14. to create aggregated and statistical data which will not identify You but which will assist Us and Our business partners, including manufacturers and brand owners of Goods to understand consumer behaviour in the market.
5.1.15 If such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on Us, or to protect and defend Our rights as a company. In the event of a fraudulent online payment, Tools4 Africa (Pty) Ltd is entitled to disclose the relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of Us.
5.2 to facilitate non-essential communication such as marketing communication or newsletters unless you have opted-out for such communications:
5.2.1. to communicate with You about goods, services, promotions, surveys, news, updates and events available on Our Sites or other related business partners; and
5.2.2. to promote competitions, to fulfil any rewards programmes, and to advertise content about our Services and or Goods or other business partners, by way of email, newsletter App banners or SMS.
5.2.3 If such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on Us, or to protect and defend Our rights as a company. In the event of a fraudulent online payment, Tools4 Africa is entitled to disclose the relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of Us.
6. Direct Marketing and Opting Out
6.1 If you are an existing customer, we may communicate with you based on the preferences as selected by you in relation to products or services you have signed up for. This may include making contact via telephone, email, sms, social media and other channels about products and or services which may be of interest to you.
6.2 You may at all times choose to opt out (free of charge) of any marketing communication or newsletter.
6.3 Every marketing communication sent to You will contain an “unsubscribe” link. Where You have elected to opt out of any direct marketing being sent to You by advising Us, such opt out will be recorded by Us and We will no longer send direct marketing to You.
6.4 You may also always opt out of Push notifications from Us by disallowing them on Your mobile phone settings.
7. Who We share Your personal Information with
7.1 You agree that We may disclose Your personal information to the following persons:
7.1.1. to Tools4Africa employees and/or third party service providers, such as to process Your Services properly and efficiently and in order for them to interact directly with You via email or any other method for purposes of sending You marketing material regarding any current or new goods or services, new features, special offers or promotional items offered by them (unless you have opted out from receiving such marketing material);
7.1.2. to law enforcement, government officials, fraud detection agencies or other third parties when We believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report or support the investigation into suspected illegal activity, or to investigate violations of the Terms;
7.1.3. to Our service providers (under contract with Us) who help with parts of Our business operations (fraud prevention, marketing, technology services etc.). Our contracts dictate that these service providers may only use Your Personal Information in connection with the services they perform for Us and not for their own benefit;
7.1.4. to third party service providers for services such as payment processing, website hosting, data analysis, infrastructure provision, IT services, customer service, e-mail delivery services, and other similar services, to enable them to provide services;
7.1.5. to third parties’ sponsors of promotions (irrespective of whether such promotions are hosted by Us), or otherwise in accordance with the rules applicable to such promotions. You should carefully review the rules, if any, of each promotion in which You choose to participate, as they may contain additional important information about Our, a sponsor’s and/or other third parties’ use of Your personal information;
7.1.6. to third party business partners like manufacturers and Brand owners (in which case we will have agreements in place to secure the confidentiality of Your Personal Information); and
7.1.7. to an affiliate or other third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Our business, assets or stock (including without limitation in connection with any insolvency and/or similar proceedings).
7.1.8. to the general public when You provide a rating or review of service received via social media, You consent to Us using that rating / review as We deem fit, including without limitation on the Sites, in newsletters or other marketing material. The name that will appear next to that review will be Your first name, as You would have provided upon registration. We will not display Your surname, nor any of Your contact details, with a rating or a review.
7.1.9. any party or third-party other than as described herein only if You consent to the sharing.
7.2 We will ensure that all of Our employees, third party service providers, divisions, affiliates and third party business partners (including their employees and third party service providers) having access to Your personal information are bound by appropriate and legally binding obligations in relation to the confidentiality and security of Your Personal Information and are restricted in their processing thereof as per this privacy policy.
8. How We hold personal information securely
8.1 All Personal Information will be securely retained and only used to fulfil the purposes listed above.
8.2 We will take appropriate, reasonable technical and organizational measures to prevent loss of, damage to, or unauthorized destruction and unlawful access to or processing of your personal information. This may include transfer of data outside of South Africa (due to the nature of our technologies being used). Information associated with your account will be kept until your Tools4.co.za profile is deleted, unless we no longer provide the Service to you.
9. Securing Your Account
9.1 You are required to create an 8-character password to secure your account.
9.2 You are responsible for making this password strong, complex and unique as well as to keep the password private and secure. Do not share this password with anyone.
9.3 You are responsible for all actions processed through your account. If you suspect its misuse or compromise, you must report it to us as soon as possible.
10. Your Right to Access Information
10.1 Depending on which product or service you (as the Data Subject) have signed up for, you can update some of your information via our digital channels. Alternatively, your information can be updated via our in office support team. You have the right:
10.1.1 free of charge, to confirm with us whether we hold any information about you;
10.1.2 at a prescribed fee, which we will give you a written estimate of,
– to request the record of information held by us
– to request a description of the information held by us, including information about the identity of all third parties, or categories of third parties, who have, or have had, access to the information
10.1.3 to update and correct any out-of-date or incorrect information we hold about you;
10.1.4 destroy or delete a record of information of you which we are no longer authorised to retain; and
10.1.5 update your communication preferences and / or unsubscribe from communications we may send you.
10.2 Before we provide you with access to your information, we may require proof of identity. We may require up to 21 (twenty-one) days to respond to any requests for information. We may refuse to disclose some information in accordance with the Promotion of Access to Information Act (PAIA).
10.3 If you require Tools4 Africa to delete all your information that we have about you, please also contact our in office support team.
Note that you will probably have to terminate all agreements you have with us. We may also refuse to delete some of your information if we are required by law to retain it or if we need it to protect our rights.
11. Changes to this Privacy Policy
11.1 Tools4 Africa may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes.
11.2 We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.

Should you believe that Tools4 Africa (Pty) Ltd has utilised information contrary to applicable law, you undertake to first attempt to resolve any concerns with Tools4 Africa (Pty) Ltd. If you are not satisfied with such process, you have the right to lodge a complaint with the Information Regulator of South Africa.
